CA Health Insurance Companies Pay Fine for Rescinding Health Insurance Policies

Health plan participants have the extra support of legal prosecutors if their health plan providers rescind their policies as a result of illness, thanks to a recent court decision. California health companies have already had to pay more than $13 million in fines to regulators as a result of having rescinded health policies for sick patience.

Health companies may have hoped that the fines would make the scrutiny over their practices go away, but, instead, legal experts expect the scrutiny to continue. The California state Court of Appeal ruled in December 2009 that prosecutors would be permitted to sue health insurance companies over the insurance companies treat consumers and their members.

The recent legal ruling is a result of a lawsuit against health giant Anthem Blue Cross of California. Prosecutors argued that Anthem violated state law by selling health plan members the promise of health insurance, but then later rescinding the health coverage after health insurance plan policy holders submitted their claims for medical care.

After the lawsuit was filed, Anthem Blue Cross argued that the company’s practice of rescinding health coverage fell under the jurisdiction of the California state Department of Managed Health Care; not the Los Angeles city attorney’s office. The city’s attorney’s office filed the lawsuit in 2008. Anthem Blue Shield and the state agency filed paperwork defending Blue Cross. Blue Shield is a competitor of Blue Cross of California and faces a similar law suit by the city’s attorney.

In response to Blue Cross’s argument, the appellate court said that the law was “unambiguous” and gave the city attorney the right to sue the insurance company. The ruling allows the city to not only pursue its current lawsuits against insurance companies, but it also gives the city more influence down the road in other areas.

“This puts new cops on the beat,” said Bryan Liang, director of the Institute of Health Law Studies at California Western School of Law in San Diego. “Lots of stuff in the standard operating practices of health plans is going to be affected by that decision.”

Additionally, Los Angeles City Atty. Carmen Trutanich said he agreed with the appellate court’s ruling. “I am committed 100% to pursuing our litigation against these insurers,” he said. “Illegally canceling people’s healthcare coverage after they get sick is unconscionable.”

Moreover, Los Angeles Assistant City Atty. James W. Colbert III suggested that the recent ruling against health insurance companies may encourage prosecutors in other cities to review the practices of health insurers in their areas. “This decision invites that kind of interest,” he said.

Anthem Blue Cross has yet to decide whether it will appeal the decision, but some believe that the company should be worried about the negative fallout of the unfair business practices.

However, the managed healthcare department said that prosecuting health insurance companies by local government offices is “duplicative regulation” that actually undermines process that has been made to “ensure quality, accessible healthcare.” As a result, some realize that health insurance companies will ultimately increase health insurance costs.

Chest Muscle Exercises

A defined chest and an increase in chest muscle is a major fitness goal for a number of people, but what are the best chest muscle exercises?

The chest is a major muscle and the centerpiece of a great physique as it is the most aesthetic muscle on your body.

Chest Press

Lower the bar down and touch your chest, keeping your upper arms close to your torso and then push the bar back up into starting position without allowing it to bounce off of your chest.

This exercise will add mass and definition to your chest, and is one of the best chest muscle exercises.

Remember to have some there to spot you whenever working out on the bench press.

Push Ups
Pushups are a great chest muscle exercise because they work almost every muscle in the body but an emphasis the chest and arms.

The basic pushup is simply and yet incredibly efficient.   Placing your hands shoulder-width apart, bend your arms and lower yourself down as far as you can. Straighten arms and push up but remember to avoid locking your elbows.

When your muscles grow more accustomed to the movement and you become used to lifting your body weight you can increase the weight by adding weights either around your waist or on your back.

Changing the width of your arms, from shoulder width to very wide, to forming a diamond with your hands in order to gain the greatest effect from the push ups.

Chest Flies
Chest flies are a great chest muscle exercise because it works the major muscles of the chest with a focus on the outer portion of the chest.

To perform chest flies lie on an incline bench holding one dumbbell in each of your hands with your palms facing towards each other just above your abdomen.  Arch your elbows out and away from your body while raising your arms up towards shoulders.  Pause for a moment before moving your hands slowly back down to your starting position.

When performing chest flies it is important to perform the movement in a slow and controlled motion.

These are just a few chest muscle exercises, but they are also the most effective chest muscle exercises when it comes to properly training and adding both mass and definition to your chest muscles.…

Propolis is a natural antibiotic that is fast gaining in popularity in the application of home remedies! It’s one of those bee products that really cause me to wow at the wonder of nature and marvel at the ability of the highly organised insect – honey bee. Now, let me tell you the fascinating story of propolis.

Some trees and conifers produce sticky resins as part of their immune system to defend themselves against disease. Honey bees collect these substances that ooze from the buds of these plants. After chewing them and mixing them with their saliva and other substances, propolis is formed. This nutrient-rich substance is of vital importance for the survival of the honey bees in the beehive. It is created to sterilize the hive and protect it against diseases and infection. Not only does it help to inhibit the spread of bacteria, virus, and fungi that would otherwise pose a significant threat in the closely-knit quarters, it also and help fight against climatic changes, such as wind and cold. Economic Argument for Single-Payer Health Insurance

Do you know why it is that there is only one garbage company serving our area? Or only one cable provider? Would it not be better to have multiple companies in these industries to increase competition and thus drive down prices for consumers?  

The answer to the latter question is no. These particular industries lend themselves to being what is known in the field of economics as “natural monopolies”—monopolies that exist because they are more efficient than competitive markets.

If a garbage company drives its truck down a street with 20 homes but only picks up the garbage at 5 of these homes, it will face higher average costs than it would if it picked up at all 20. Let it pick up all 20 houses and it will face lower average costs that can be passed on to consumers in the form of lower prices only if mandated by a governmental authority (which it is, by the way). At the same time, the number of trucks spewing pollution and snarling traffic is reduced by allowing just one company the exclusive franchise.

The health insurance industry fits this same mold. A health insurance company is profitable when it can have a vast number of healthy premium payers to counter the few unhealthy ones. The more people (and healthy ones at that) they add as customers, the more they lower their average costs.

But since the insurance industry is a competitive one, no firm is required to pass on those lower average costs to the consumer in the form of lower premiums. And since the demand for health insurance is relatively inelastic (like cigarettes to a smoker), consumers will continue to bear the burden of higher premiums rather than go without—many consumers can’t switch to a competing insurer because they may have pre-existing conditions or get their coverage from their employer. It is no wonder these corporate health insurance providers are reaping huge profits, such as Well Point’s $61 billion last year alone (this, despite the economic downturn).

Now, I have nothing against companies or individuals reaping profits for providing solutions—profit is a great motivator. And the price system is an effective way to allocate the things people want. But by its very nature, the price system necessitates that some consumers will not be able to afford certain items. For example, if I want a giant flat-screen TV but can’t afford the price the seller is asking, I don’t buy it. If enough people don’t buy it, the price eventually comes down to the point where a few more can afford to buy, but not everyone. This is a very effective system for allocating most everything. The question we should ask ourselves is should it be the system we use to allocate life-saving health care? Think about it: we don’t use the price system to allocate police protection—everybody gets it regardless of their ability to pay. It would be an insult to our police force to suggest that they only protect those that can afford to pay the price. Besides, that would be extortion.

A single-payer health insurance provider can take advantage of the natural monopoly phenomenon. Every working individual would pay into the system and every American citizen would be covered. There would be ample healthy payers to make this system not only viable, but much less expensive than that offered by private insurers.

Many Americans fear a government take-over of the health insurance industry. But I would wager to guess that many of these same people regard America’s military as the most powerful in the world despite being government-run. Or they claim that our fire fighters are the bravest, even though their paychecks are financed by our tax dollars. By the way, fire companies were once privately owned: At some point we saw the inherent flaw in that arrangement and now our fire departments work for the public good.

When the natural monopoly that was our electrical system in the state of California was deregulated in the misguided attempt to introduce competition, it was a disaster. In order to ensure that prices wouldn’t skyrocket (which is what happens when a natural monopoly is broken up), the state imposed price …
